General Conditions of Use

These general conditions of use (hereinafter referred to as the "GCU") govern, without restriction or reservation, the relationship between: Saint François Longchamp Tourisme, via the Centrale de Réservation (SAEM with capital of €100,000, RCS Chambéry, Siren 833 975 444, VAT FR09833975444) whose registered office is Maison du Toursime 73130 Saint François Longchamp; and all users of the Saint François Longchamp marketplace site (hereinafter referred to as the "User(s)").

The purpose of these terms and conditions is to govern the conditions of use of the website accessible at the URL https://reservation.saintfrancoislongchamp.com/ or https://booking.saintfrancoislongchamp.com/ (hereinafter referred to as the "Website"),

Acceptance and enforceability of the GCU

The User declares that he/she has read these GTUs.

In any event, any use of the Website by the User implies unreserved acceptance of the GTUs in force. The User may be required to accept them expressly by ticking the box provided for this purpose when completing the online order procedure.

The GCU may be consulted and printed at any time using the direct link on the home page of the Website. Where applicable, they shall prevail over any other version or any other contradictory document.

As the GCU may be subject to subsequent modifications, the version applicable to the User is that in force on the Internet Site on the date the order is placed. In the event of the User browsing the English language version of the site, and even in the presence of general terms and conditions of use of the site in English, the applicable version will always be the French version.

Service features

Saint François Longchamp Tourisme has developed an online platform whose main activity is the aggregation of commercial offers from partners (hereinafter referred to as the "Partners"), enabling Saint François Longchamp's offers to be pooled in order to improve the range of services offered to Users.

The Website presents the User with the commercial offers of the Partners, which include, among others :

Reservation of ski passes
Accommodation and Concierge services
Equipment hire
Booking ski lessons
Activities in the resort
The User can then choose and book one or more commercial offers that meet the needs of their holiday.
The commercial offers that appear on the Website are proposed by Partners who may be professionals or non-professionals - particularly in terms of accommodation.

Ranking of commercial offers

The presentation of commercial offers on the Website is generally based on availability, price and geolocation. In particular, the list of accommodation is presented next to a map of the destination showing its location.

Online booking and ordering procedure

General use

The online ordering procedure is reserved for Users who are at least 18 years old and have the legal capacity to contract.

The User must have the consent of all persons for whom services are booked through the Website, as well as the authorisation of the parents of all minors taking part.

The User guarantees the truthfulness and accuracy of the information provided.

When ordering online, acceptance of these GCU and of the Partners' general terms and conditions of sale is made by ticking the box provided for this purpose. Failure to do so will make it impossible to proceed with the order.

Choosing and ordering commercial offers

The User may order online, from the Website, one or more commercial offers proposed by the Partners.

The ordering procedure comprises - at the very least - the following steps:
  • The User is asked to select the date of their stay;
  • Following the User's choice, the Internet Site communicates the various commercial offers available from its Partners: accommodation and/or ski pass and/or ski lessons and/or equipment hire and/or activities and/or services;
  • Depending on their needs, Users can choose between one or more commercial offers;
  • A summary showing all of the User's choices and the characteristics of the commercial offer(s) chosen enables the User to check the details of their order online;
  • The User may then, subject to acceptance of these GCU and the general terms and conditions of each Partner whose offer has been selected by the User, validate his/her order;
  • The User must then pay the price. The contract is then validly concluded between the User and the Partner or Partners selected;
  • Finally, the User receives an order confirmation email from each of the Partners with whom he has booked a service.

Commercial rates

The prices of commercial offers are freely set by the Partners. Prices are expressed in euros (€).Prices are subject to change and are enforceable against the Website User from the time they are put online. The applicable price is that in force on the day of the order.

Online order payment

Validation of an order on the Website entails payment thereof, in accordance with the terms specified by the Partner(s) concerned, online, in particular by bank card (Visa MasterCard, E-carte bleue).
The User guarantees that the means of payment used is valid and not the result of a fraudulent transaction.

Once payment has been made, the order can no longer be modified.

Online payment is made via a payment service provider, an electronic money institution; approved in France and supervised by the ACPR (Autorité de Contrôle Prudentiel et de Résolution).

Saint François Longchamp Tourisme cannot be held responsible for the operation of the online payment service.

Right of withdrawal

In application of article L. 221-28 of the French Consumer Code, the services and accommodation, transport, catering and leisure activities offered by the Internet Site, which must be provided on a specific date and at a specific time, are not subject to the right of withdrawal.

Consequently, the services ordered on the Internet Site are subject exclusively to the cancellation and modification conditions set out in the specific conditions of service of each of the Partners.

Liability

For use of the website

Due to the nature of the Internet, Saint François Longchamp Tourisme can only be held responsible for the operation, availability and continuity of the Website on a best effort basis.

Saint François Longchamp Tourisme may not be held liable in the event of malfunctions, anomalies, errors or bugs of any kind, making use of the Website totally or partially impossible.

Saint François Longchamp Tourisme cannot be held responsible for the use that the User makes of the information made available via the Website, the User being and remaining solely responsible for the use that he makes of it.

Saint François Longchamp Tourisme endeavours to provide Users with the most reliable and qualitative information available. However, it does not guarantee the accuracy or completeness of the information published on the Website.

For commercial offers

Saint François Longchamp Tourisme neither controls nor guarantees the quality, security, suitability or legality of the commercial offers proposed by its Partners and present on the Website. In the event of difficulties, the User must contact the Partner(s) concerned directly.

Each Partner is solely and fully responsible for the offers it presents and makes available to Users of the Website, both in terms of their compliance with the applicable provisions and the characteristics presented.
Saint François Longchamp Tourisme may not be held liable for the non-performance or poor performance of all or part of the services provided and implemented by the Partners.

The offers presented on the Website are not exhaustive of all the offers available at Saint François Longchamp.

Privacy policy

Plausible Analytics uses the data anonymously to analyse the use of the site on behalf of the site operator. It is then used to compile statistical reports that measure and analyse the number of visits to the site and its pages, the average time spent on the site and the pages consulted.

Alpe d'Huez Vacances may from time to time use Hotjar (mouse tracking) which will temporarily install cookies on the website to analyse the customer's visit. This data will allow Alpe d'Huez Vacances to improve the website and the customer's shopping experience.

Intellectual property rights

All intellectual property rights, in particular copyrights, relating to the general structure of the Website as well as to the texts, illustrations, photographs, animations, sounds, software, interfaces, computer programmes and any other element making up the Website remain the exclusive property of Saint François Longchamp Tourisme or their respective holders in accordance with the provisions of the French Intellectual Property Code, and may not be used without prior authorisation.

Nothing herein may be interpreted as assigning or transferring to the User all or part of the intellectual property rights relating to the Website or to any of its component parts.

Any use, commercial or otherwise, in particular any downloading, copying, reproduction, distribution, transmission, broadcasting, adaptation, translation or representation, whether in whole or in part, of the Website or of any of its component parts by any means and process now or in the future, on any medium now or in the future, without the prior written authorisation of Saint François Longchamp Tourisme is prohibited and may give rise to legal proceedings, in particular but not exclusively on the grounds of infringement, unfair competition and/or parasitism, punishable by the applicable provisions in force.

Nullity

If any one of the stipulations of these GCU is found to be null and void with regard to a rule of law in force or a judicial decision that has become definitive, it will then be deemed unwritten, without this resulting in the nullity of these GCU or altering the validity of its other stipulations.

Applicable law - Language

The GCU and the operations arising from them are governed by and subject to French law.
The language of these GCU is French. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.

Dispute

Access to the courts

Any dispute arising from the validity, interpretation, performance or termination of these GCU, and more generally from relations of any kind between Saint François Longchamp Tourisme and the User, will initially be submitted to a conciliation phase. Failing amicable settlement, the dispute will be brought before the competent courts.

Mediation

Saint François Longchamp Tourisme, the Partners and the User will endeavour to resolve amicably any difficulties that may arise in the application of these conditions.

In the absence of a satisfactory response or in the absence of a response within 60 days, the User is informed that he/she may, in any event, have recourse free of charge to conventional mediation with the Tourism and Travel Ombudsman, whose contact details and procedures for referral are available on its website: https: //www.mtv.travel.

Mandatory pre-contractual information

The User acknowledges having been informed, prior to placing the order, in a legible and comprehensible manner, of these GCU and of all the information listed in article L. 111-1 et seq. of the French Consumer Code, in particular:

  • The essential characteristics of the service, taking into account the communication medium used and the service concerned;
  • The price of the service and any ancillary costs to be expected;
  • The methods of classifying and referencing the commercial offers proposed on the Website
  • The terms of payment;
  • If the contract is not to be performed immediately, the date or deadline by which the Partner undertakes to perform the service;
  • Information relating to the identity of the Partner, its postal, telephone and electronic contact details and its activities, insofar as this is not apparent from the context;
  • Information relating to the legal guarantees, the functionalities of the digital content and, where applicable, its interoperability, the existence and terms of implementation of the guarantees and other contractual conditions;
  • The possibility of recourse to a mediator in the event of a dispute.
